ADA is the
Law: You Can't Opt Out!
In 1992 the Americans
with Disabilities Act (ADA) was created and now, fifteen years later,
most business owners are still unfamiliar with how to comply. The
truth is that 20% of Americans suffer from a disability, so if your
business does not offer accessible public accommodations, this is
a violation of civil rights. Unfortunately, as more small businesses
are being sued, one quarter of all federal court cases involve ADA,
so it is highly necessary to take action today.
Before you begin
to loose sleep, make an appointment with the City of San Diego's Development
Services Department (691.446.5000) for preliminary help. They'll answer
any questions over the counter, they can provide an accessibility
checklist, and recommend how to start your ADA compliant action plan.
Installing ramps and curb cuts are often considered financial hardships
which can not be mandated, but proper parking signage, door handles,
and small adjustments to your public restaurant are doable, and will
save you from future financial hardship. If you are the tenet or the
landlord, and you believe that this is not your responsibility, please
re-read your lease agreement. Most often, both are jointly responsible
and being grandfathered is a myth. All businesses must comply!
For an excellent
internet resource, go to
www.lawyersagainstlawsuitabuse.com for "The ADA Top 40"
which shows the most common issues on properties which lead to ADA/access
lawsuits. Many of these items cost less than $100 to resolve and may
save you thousands of dollars in law suits.

can also find the booklet, 'Accessibility Guide for Small Businesses'
on the City of San Diego's Development Services Accessibility section
of their website www.sandiego.gov/development-services/industry/accessibility.shtml.
